OFFICE MEMORANDUM
Subject: Fixation of pay of re-employment pensioners.

At present, the orders relating to fixation of pay of reemployed pensioners are scattered in a number of office memoranda issued from time to time. The question of consolidation of the existing orders in a simple body of orders and the rationalization and simplification of the procedure governing the initial fixation of pay has been under consideration of the government from time to time. The President is now pleased to decide that in supersession of all the previous orders on the subject, the initial fixation of pay and other benefits on reemployment of ex-servicemen pensioners as also civilian pensioners will be governed by the Central Civil Services (Fixation of Pay of Reemployed Pensioners) Orders, 1986 as detailed in the Annexure. With reference to all the appointments made on or after the 1st July, 1986, the pay of the reemployed pensioners may be fixed as per the enclosed orders.

In their application to the employees serving in the Indian Audit and Accounts Department, these orders issue in consultation with the Comptroller and Auditor General of India.

CENTRAL CIVIL SERVICES (FIXATION OF PAY OF REEMPLOYED PENSIONERS) ORDERS, 1986

1. Short Title and Commencement

(1) These orders may be called the Central Civil Services (Fixation of Pay of Reemployed Pensioners) Orders, 1986.
(2) They shall come into force on [date].

2. Application

(1) These orders shall apply to all persons reemployed in Civil Services and posts under the Union Government after retirement on pension, gratuity, or Contributory Provident Fund benefits from:
  • Union Government (including Railways, Defence, Posts and Telegraphs),
  • State Governments and Union Territory Administrations,
  • Public Sector Undertakings, Local Bodies, Autonomous Bodies (e.g., Universities).
(2) Exclusions: These orders do not apply to:
  • Persons reemployed after resignation/removal/dismissal (without terminal benefits),
  • Posts not debatable to Civil Estimates,
  • Casual/daily-rated/part-time employees,
  • Consultants paid consolidated fees,
  • Retired judges appointed on Commissions/Committees.

3. Definitions

  • Pension: Gross monthly pension, pension equivalent of gratuity/CPF, or other retirement benefits.
  • Pre-Retirement Pay: Substantive pay last drawn (including special pay, deputation allowance, etc., under specified conditions).

4. Fixation of Pay on Reemployment

  • Pension Fully Ignored: Initial pay fixed at the minimum of the reemployed post’s scale.
  • Pension Partially Ignored: Pay fixed at the last pre-retirement pay stage (or nearest lower stage). Adjustments made for non-ignorable pension.
Special Cases:
  • Ex-servicemen below commissioned rank: Entire pension ignored.
  • Group A officers: First ₹500 of pension ignored.

5. Drawal of Increments

  • Increments allowed as if pay were fixed at the minimum/higher stage (pre-adjustment), subject to a cap of ₹3,500/month (pay + pension).

6. Invalid/Compensation Pensioners

  • May opt to retain pension (forfeiting past service) or forego pension to count past service for future benefits.

9. Promotion/Transfer

  • Pay fixed under Fundamental Rules, with continued pension adjustments (cap of ₹3,500/month).

10. Provisional Pay

  • Pending final pension determination, pay may be fixed provisionally for up to 6 months, subject to recovery agreements.
16. Ex-Combatant Clerks/Storemen
  • Option to fix pay based on equivalent civilian service years, with pension deductions (₹15 ignored).

Annexure I: Agreement for provisional pay (including pension but excluding gratuity/CPF equivalents).
Annexure II: Monthly receipt format for provisional pay adjustments.
