Subject: CAT cases regarding reduction in period of commuted value of pension from 15 years to 10/12 years.

Madam/Sir,
I am directed refer to the number of cases filed in various CATS in the Circles on the subject mentioned above and to inform that Postal Directorate had taken up all such cases with the Department of Pension & Pensioners' Welfare (DOPPW).

2. The DoPPW has provided their inputs and requested the Department of Posts to defend the cases in the court of law.

3.The Department of Posts has now taken up the cases with Department of Legal Affairs (DOLA) and after necessary inputs from DOLA, the case shall be referred to the Department of Expenditure for their inputs. The completion of this exercise shall take some time.

4. Meanwhile, all Circles concerned are requesting for expediting instructions from the Department of Posts to deal with such the cases.

5. In view of the above, Circles, who have received cases on the subject, are requested to seek at least 03 months time from the Ld. Tribunal/Court for filing the Counter affidavit.

6.It may be accorded priority please.

Background

The Postal Directorate has taken up cases related to the subject matter with the Department of Pension & Pensioners' Welfare (DoPPW) in response to cases filed in various Central Administrative Tribunals (CATs) in the Circles.

Current Status

The DoPPW has provided inputs and requested the Department of Posts to defend the cases in court. The Department of Posts has subsequently taken up the cases with the Department of Legal Affairs (DOLA) for further guidance.

Next Steps

After obtaining necessary inputs from DOLA, the case will be referred to the Department of Expenditure for their inputs. This process is expected to take some time.

Instructions to Circles

In the meantime, Circles that have received cases on the subject are requested to seek at least 3 months' time from the Tribunal/Court for filing the Counter affidavit. This matter should be accorded priority.
