Blacklisting from participating in GeM - case study of 'WCC TRADE'

The Assistant Director, Postal Training Centre Guwahati hereby proposes that the firm, namely WCC TRADE, RZ-530/24, Tughlakabad, South Delhi-110019, may be BLACKLISTED and to be debarred from participating in GeM for a period as mentioned here under and for the following reason.

2. The case history in brief is furnished below:

2.1. 15 (fifteen) numbers of All in One Desktop Computers were processed for procurement by PTC, Guwahati as a Buyer Unit and the process was initiated through GeM Portal as per Rule 149 (ii) of GFR 2017, i.e., through the GeM Seller having lowest price amongst the available sellers, of at least three different manufacturers, on GeM, meeting the requisite quality, specification and delivery period.

2.2. The L1 Per Unit Price offer by the said Seller in GeM portal for Acer Intel Core i7 All in One PC with 21.5 Inch Display / Windows 10 Professional was 58,160/- and the item in question was Carted on 27.09.2024 for procurement of 15 numbers of units amounting to 8,72,400/-.

2.3. The procurement was initiated for Upgradation of Training Facilities, fund of which was allotted under Scheme Head of Account 2552.00.806.02.04.13-NE which was directed to be utilized by December 2024.

2.4. The Competent Authority accorded approval for procurement of 15 numbers of Acer Intel Core i7 All in One PC with 21.5 Inch Display / Windows 10 Professional amounting to 28,72,400/- at L1 rate of 58160/- per unit and also allowed to re-cart at same or lower rate.

2.5. PTC Guwahati initiated the procurement process through GeM portal and Contract was successfully generated vide Contract No. GEMC-511687755198705 dated 05.10.2024 and the portal assigned the Contract to GeM Seller ID 786E200001469270, under Company Name 'WCC TRADE' being the L1 vendor.

2.6 The said L1 vendor, namely WCC Trade, having address at RZ-530/24, Tughlakabad, South Delhi, Delhi-110019, accepted the order on 05.10.2024 in GeM portal.

2.7. And whereas, on 16.10.2024, the said GeM Seller, namely WCC Trade, submitted email from his GeM Seller registered email id tradewcc@gmail.com to Buyer registered email id- ptcguwahati@indiapost.gov.in, the extract of which is reproduced below-

"We regret to inform you that the product associated with your recent order has been discontinued by the OEM, and we are no longer able to supply it. The GEM portal has already been updated to reflect this change.

We are unsure how this order was processed from your side given the update. Therefore, we kindly request that you cancel the current order and process a new one with an alternative product that we can supply."

Thus, by such action on its part, the GeM Seller, namely, WCC Trade, having address at RZ-530/24, Tughlakabad, South Delhi, Delhi-110019 has violated the General Terms and Condition on GeM 4.0 (Version 1.19) dt 26th September 2024 Para, 6 (i), which resulted in non utilization of Plan Fund in the given time-frame.

3.2. The Buyer, i.e., PTC Guwahati vide letter No. 494/PTC/All in One-Desktop/2024 dated 28.10.2024, gave an opportunity to the L1 vendor to supply the item in question within the specified date furnished in the contract but the seller did not supply the item in question.

3.3. The Seller, on the other hand, raised an incident vide no 2018619 against the buyer on 11/11/2024, alleging that Buyer has cancelled the contract after acceptance of the same by the seller/Service provider, which is a false allegation and GeM portal found the incident not meritorious, hence the incident was closed and advised the Buyer (PTC Guwahati) to raise an incident against the said Seller, namely WCC Trade. Incident vide no 2025766 was raised accordingly against the Seller, WCC Trade.

3.4. Gem System on 05.12.2024 advised Buyer to escalade the issue.

4. Thus, the Seller WCC Trade, by declining the Contract/Order, placed through GeM Direct L1 purchase and giving false accusation by raising incident against the Buyer, invited the Buyer entity to take appropriate action as deemed fit as per GeM GTC 4.0(Version 1.19) dated 26th September 2024, Para 6 (i); and therefore, the Buyer entity 'BLACKLIST' the GeM Seller, namely, WCC Trade for a period of two years from the date of issue of this order.
