As per Directorate No.17-31/2016-GDS dated 15.11.2021, the following criteria must be met for engaging a defence assistant in disciplinary cases:
- The individual must be willing to appear as a defence assistant.
- They should have in-depth knowledge of CCS (CCA) rules, BO rules, and GDS (Conduct and Engagement) Rules 2020.
- They should not be a practicing legal professional.
Additionally, the following limitations apply:
- Retired government servants can assist in no more than 7 cases simultaneously, including those under Rule 10 of the GDS (Conduct and Engagement) Rules 2020 (as per No. 17-31/2016-GDS dated 09.04.2021).
- Serving government servants can assist in no more than 3 cases simultaneously, including those under Rule 10 of the GDS (Conduct and Engagement) Rules 2020 (as per No. 17-31/2016-GDS dated 19.09.2019).
