The following guidelines outline the procedures for disciplinary proceedings against government servants after retirement:
1. Mandatory Consultation: Before issuing final orders, the Disciplinary Authority must consult with the Union Public Service (UPS) in all cases, including both gazetted and non-gazetted employees.
2. Dropping Proceedings: If the Disciplinary Authority who initiated proceedings while the pensioner was in service wishes to drop them, they must submit their findings to the President for approval.
3. Minor Penalty Proceedings: If minor penalty proceedings were initiated against a government servant while in service, these proceedings automatically become Rule 9 proceedings after retirement. To avoid complications, Disciplinary Authorities should finalize minor penalty proceedings before the government servant's retirement.
4. Continuing Disciplinary Proceedings: The decision to continue disciplinary proceedings after retirement is not solely based on the loss suffered by the government. Even in the absence of pecuniary loss, a pensioner's pension can be withheld or withdrawn for misconduct committed while in service.
