Sub: Implementation of Citizenship (Amendment) Act, 2019, (CAA) - clarification regarding Sir/Madam,
This is regarding implementation of Citizenship (Amendment) Act, 2019. During the review & clarifications sought by circles, a number of issues brought to the notice of this office regarding processing of applications under CAA 2019. The following issues were emerged during the meetings/discussions: -
I. What type of documents may be accepted from the applicants against Sr. No. 8 of the Schedule I(A) of the Citizenship Amendment Act.
II. Deficiency remarks given by SLEC in few applications as "In affidavit from

Indian National, document to prove nationality of person providing the affidavit not uploaded"
The issues are clarified after the examination as per the following: -
MHA has clarified vide letter no. 26011/01/2015-IC-I (Part) dated 8th July 2024 that the documents under Sr. No. 8 of the Schedule I(A) may include any document issued by the Central Government / State Government / any Judicial or Quasi-Judicial body in India such as Land Record, Judicial Order etc., identifying or representing that the applicant or their parents or grandparents or great grandparents had been a national of Afghanistan or Bangladesh or Pakistan. (Copy of MHA letter attached)
In view of above, any documents issued by above mentioned authority identifying or representing that the applicant or their parents or grandparents or great grandparents had been a national of Afghanistan or Bangladesh or Pakistan may be considered.
II.
It is clarified that as per Gazette notification in r/o the Citizenship (Amendment) Act, 2019 issued on 12th December 2019, only affidavit testifying the character of the applicant is to be given by an Indian citizen. There is no requirement of additional documents to prove nationality of Indian National providing the affidavit to the applicant.
This may be brought to the notice of all concerned.
