43. Retirement on completion of twenty years' qualifying service.-
At any time after a Government servant has completed twenty years' qualifying service, he may, by giving notice of not less than three months in writing to the appointing authority, retire from service and in the case of such retirement the Government servant shall be entitled to a retiring pension calculated in accordance with rule 44: Provided that before giving notice of voluntary retirement, a Government servant shall request the appropriate administrative authority for a certificate regarding completion of qualifying service of twenty years on the intended date of retirement and the administrative authority shall issue the required certificate within fifteen days of such request by the Government servant and if no such certificate is issued by the administrative authority within the prescribed period of fifteen days, the Government servant may give the notice of voluntary retirement without such certificate: Provided further that before accepting the notice for voluntary retirement and passing orders in this regard, the appointing authority shall satisfy itself that the Government servant has completed the qualifying service of twenty years:
Provided also that a Government servant shall be eligible to retire under this rule only if he has completed or will complete a qualifying service of twenty years on the intended date of retirement and the provision in sub-rule (7) of rule 44 for treating fraction of a year equal to three months and above as a completed six monthly period, shall not be applicable for the purpose of determining the qualifying service under this rule...

20 ஆண்டு கால தகுதி வாய்ந்த சேவை முடிந்த பின் பெறப்படும் விருப்ப ஓய்வு: 20 ஆண்டு கால தகுதி வாய்ந்த சேவை முடித்த பின் எந்த நேரத்திலும் ஒரு ஊழியர் 3 மாத கால அவகாசம் கொடுத்து தான் விருப்ப ஓய்வில் செல்வதற்கு நியமன அதிகாரிக்கு விண்ணப்பிக்கலாம், இம்மாதிராயன சூழலில் விதி எண் 44 ன் படி ஓய்வூதியம் கணக்கிடப்படும்.
20 ஆண்டு கால தகுதி வாய்ந்த சேவை முடித்த ஊழியர் ஒருவர் இவ்வாறு விண்ணப்பிக்கும் முன்னர் தான் 20 ஆண்டு கால தகுதி வாய்ந்த சேவை முடித்ததற்கான சான்றிதழை உரிய அதிகாரியிடம் கேட்டிடலாம். இந்த வேண்டுதல் பெறப்பட்ட 15 நாட்களுக்குள் இதற்குரிய சான்றினை அந்த அதிகாரி வழங்கிட வேண்டும். அவ்வாறு வழங்கிடாத பட்சத்தில் அந்த ஊழியர் விருப்ப ஓய்வில் செல்வதற்கான கடித்தத்தினை அதொகாரிக்கு அனுப்பிடலாம்.
ஊழியர் சமர்ப்பித்திடும் அறிவிப்பினை ஏற்று அவரை விருப்ப ஓய்வினில் செல்ல அனுமதித்திடும் முன்னர் அவர் 20 ஆண்டு கால தகுதி வாய்ந்த சேவை முடித்தவரா என்பதனை உறுதி செய்திட வேண்டும்.
மேலும் இந்த விதியின் கீழ் விண்ணப்பிக்கும் ஊழியர் தான் விருப்பத்தினை சமர்ப்பிக்கும் நாளன்று அல்லது அவர் விருப்ப ஓய்வில் செல்வதாக அறிவித்த தேதியன்று 20 ஆண்டு கால சேவியினை பூர்த்தி செய்திருக்க வேண்டும், ஓய்வூதிய பலனிற்காக கணக்கிடும் போது 3 அல்லது அதற்கு அதிகமான மாதங்கள் தகுதி வாய்ந்த அரையாண்டு சேவைக் காலமாக கருதப்படும், அம்மாதிரியான கணக்கீடு இதற்கு தகுதி வாய்ந்த சேவையினை கணக்கிட எடுத்துக் கொள்ளப்படாது...
