41. Compassionate allowance.-

(3) The competent authority shall consider,-

(a) each case of dismissal and removal from service on its merit to decide whether the case deserves of special consideration for sanction of a compassionate allowance and, if so, the quantum thereof.

(b) the actual misconduct which occasioned the penalty of dismissal or removal from service and the kind of service rendered by the Government servant.

(c) in exceptional circumstances, factors like family members dependent on the Government servant along with other relevant factors.

(4) Where an order imposing the penalty of dismissal or removal from service was issued before the date of commencement of these rules and the competent authority, at that time, did not examine or decide whether or not any compassionate allowance was to be granted in that case, that authority shall take a decision in this regard not later than six months from the date of commencement of these rules.

(5) No compassionate allowance shall be sanctioned after the expiry of the aforesaid period of six months, to a Government servant on whom a penalty of dismissal or removal from service was imposed before the date of commencement of these rules. (6) A compassionate allowance sanctioned under the proviso to sub-rule (1) shall not be less than the amount of minimum pension under rule 44

40. கட்டாய ஓய்வின் போது வழங்கப்படும் ஒய்வூதியம்:-

& தகுந்த அதிகாரி கீழ்க்கண்டவற்றை பரிசீலித்திட வேண்டும்,

ஒவ்வொரு பணி நீக்க அல்லது விடுவிப்பு வழக்கிலும் அந்த வழக்கின் தன்மை ஆராய்ந்து அதற்கு தனி மற்றும் சிறப்பு சலுகை வழங்கி கருணை அடிப்படையிலான கொடுப்பணவு கொடுத்திட வேண்டுமா, வேண்டின் அவற்றின் அளவு எவ்வளவு என்ற முடிவினை எடுத்திட வேண்டும்.

V பணி நீக்கம் அல்லது விடுவிப்பு வழக்கினில் அந்த ஊழியர் செய்த தவறு அவர் அதுவரை ஆற்றிய சேவை

♥ சில அதீத சூழல்களில் ஊழியரை சார்ந்திருந்த குடும்பத்தாரின் எண்ணிக்கை மற்ற பிற காரணங்கள் CCS (Pension)விதிகள் 2021 நடைமுறைக்கு வரும் முன்னர் பணி நீக்கம் அல்லது விடுவிப்பு ஆணை வழங்கப்பட்ட வழக்குகளில் இந்த கருணை அடிப்படையிலான கொடுப்பணவு வழங்கிட பரிசீலனை செய்யப்பட்டிருக்க மாட்டாது, அம்மாதிரியான வழக்குகளில் கூட இந்த ஆணை வெளிவந்த தேதியிலிருந்து 6 மாத காலத்திற்குள் அம்மாதிரியான ஒரு முடிவினை எடுத்திட இயலும்.

6 மாத காலம் முடிவடைந்த பின்னர் கருணை அடிப்படையிலான கொடுப்பணவு வழங்கும் முடிவினை எடுத்திட முடியாது.

V விதி எண் 44 கீழ் உள்ள ஓய்வூதியத்தை விட மேலே சொன்னவாறு வழங்கப்படும் இந்த கருணை அடிப்படையிலான கொடுப்பணவு குறைவாக இருந்திடக் கூடாது...
