Sub:-Transfer under Rule-38-reg.
Sir/Madam,
I am directed to draw your kind attention towards subject cited above and to intimate that, we are in receipt of complaint from Association side about non following of norms as enumerated in Rule 38 of Postal Manual Volume-IV and the updated guidelines issued by Department of Posts vide its letter No.141-141/20136-SPB-II dated 17.01.2019 in inter-circle transfer cases.
In-spite of instructions vide this office letters dated 30.01.2020 & 18.02.2020 to clear the rule-38 transfer cases; it seems that nothing tangible in this regard has been done in your office. Further it is quite disappointing to attract such complaints on violation of the prevalent rules/guidelines. Non-considering of Rule-38 transfer cases leads to disappointment of the applicants who are seeking voluntary transfer through proper channel at his/her own request. This further gives an opportunity to the candidates indirectly bring external influence like DO letters from dignitaries, PG portal complaints etc. This adds to file work and also hampers the trust of other applicants who could not approach external influences to affect their transfers. Non-compliance and non-reporting of rule-38 transfer cases disturbs the vacancy positions which are intimated to SS yearly. Further, it has been directed by the Competent Authority to consider all pending rule-38 transfer cases on priority basis for their disposal strictly according to prevalent rules/guidelines. The status of such cases may be reported to this office within one month of receipt of this letter. This issues with the approval of competent authority.
