CCS (CONDUCT)RULES,1964

 
Definition : GS - Government Servant
Rule and Description :

Rule 3(1)(i) –   Maintain absolute integrity

Rule 3(1)(ii) –  Maintain devotion to duty

Rule 3(1)(iii)-   do nothing which is unbecoming of a government servant
Rule 3(2)(i) –   Supervisors to ensure the integrity and devotion  to duty of government servants under them

Rule 3(2)(ii)-    Govt servant to act in his best judgement except when act under the direction of his official superior

Rule 3(2)(iii)-   Direction of superiors to be in writing. If oral direction is inevitable, he should confirm it in writing immediately without much loss of time

Rule 3(2)(iv)-   A govt servant acting on oral direction should get it confirmed in writing by the superior

Promptness and courtesy(Rule 3-A)

GS should not act in a discourteous manner in official dealings with the public or should not adopt dilatory tactics or willfully cause delay in disposal of work assigned to him

Observance of Govt policies(Rule 3-B)

GS shall act in accordance with Govt’s policies regarding age of marriage, preservation of environment, protection of wildlife, cultural heritage and Observe policies regarding prevention of crime against women

 Act of Unbecoming of Govt servant(Rule 3(1)(iii))


  • Detention in custody or conviction by a court to be intimated by the Govt. servant to the superiors
  • Joining educational institutions beyond working hours-Permission to be obtained-Tenure of his present to be taken into account while granting permission
  • Permission not necessary for redressal of grievance in a court of law
  • Govt servant is expected to maintain reasonable and decent standard of conduct in private life – look after family
  • Religious favours using official position not allowed
  • Untouchability not allowed
  • Joint representation by Govt servants not allowed
  • Proper decorum to be observed during lunch break
  • Leaving headquarters without permission
  • Making correspondence direct with higher authorities who are not the direct superiors.

What are termed as misconduct?

  • Act or conduct prejudicial to the interest or reputation of the State
  • Inconsistent or incompatible with the peaceful discharge of his duty
  • Makes it unsafe for the employer to retain in service
  • Grossly immoral
  • The employer cannot rely on the faithfulness of the employee
  • The act is such which create temptations for not discharging duties properly
  • Abuse or disturb the peace at the workplace
  • Insulting and insubordination
  • Habitually negligent
  • Even isolated negligence if it cause serious consequences
  • Wilful insubordination whether alone or in line with others
  • Infidelity, unfaithfulness, dishonest, untrustworthiness, theft, fraud
  • Strike, picketing, gherao
  • Moral misconduct – riotous or disorderly behaviour
  • Habitual late attendance
  • Habitual absence without permission and over-stayal of leave
  • Conviction by a Criminal Court

Politics(Rule 5)

  • Should not be a member of a political party or any organization which takes part in politics or should not assist, subscribe any such party or organisation
  • Family members shall not be allowed to take part in politics – Otherwise report
  • This rule does not attract – casting vote in an election and performing election duty
  • But it attracts – displaying electoral symbol on vehicles, residence, functioning as booth agent, nominating or seconding nomination in an election, taking active part in meetings and demonstration of political parties

Demonstration and strike(Rule 7)

  • Should not participate in any demonstration which is prejudicial to the interests of the sovereignty and integrity of India, security of the State, friendly relation with foreign states, public order, decency or morality, or which involves contempt of Court, defamation or incitement to an offence
  • Shall not resort to or in any way abet any form of strike or coercion or physical duress in connection with any matter pertaining to his service or the service of any other govt servant

Gift(Rule 13)

  1. Shall not accept any gift or permit any member of family or person acting on his behalf to accept any gift 
  2. Permitted in marriages, anniversaries, funerals or religious functions if the value exceeds
  • Rs.7000/- for Group-A, Rs.4000/- for Gr-B, Rs.2000/- for Group ‘C’ and Rs.1000/- for MTS
  • In other cases, the value limit is Rs.1500/- for Gr-A and B and Rs.500/- for Gr-C or MTS

Dowry(Rule 13-A)

  • No GS shall give or take or abet giving or taking of dowry or demand directly or indirectly from the parent or guardian of a bride or bridegroom 

Private Trade or employment(Rule 15)

No govt servant shall engage directly or indirectly in any trade or business or negotiate for or undertake any other employment or hold an elective office or canvass for a candidate or candidates for an elective office in any body or canvass in support of any business of insurance agency, commission agency etc. owned or managed by any member of his family

Permissible: Honorary work of a social or charitable nature, occasional work of literary, art, science, participate in sports as an amateur, registration/promotion of literary, scientific or charitable society, club the aims of which are related to sports culture, recreational activities etc.  

Investment, lending and borrowing(Rule 16)

Shall not speculate in any stock, share or other investment – except occasional investment through approved brokers


Family members also not allowed if it will influence in discharge of official duties

GS and members of family should not lend or borrow or deposit money with a person or firm or private limited company  if it is likely to influence his official dealings

Insolvency and habitual indebtedness(R- 17)

  • Shall manage his private affairs as to avoid habitual indebtedness or insolvency 
  • He should report if any legal proceedings are instituted against him for recovery of any debt due from him or for adjudging him as insolvent

Movable & immovable property(Rule 18)

  • On first appointment every govt servant shall furnish a return of his assets and liabilities in the prescribed format showing details of immovable property inherited, owned or acquired either in own name or family,
  • Shares, debentures, bank deposits inherited/owned
  • Movable property inherited/owned
  • Within one month should report if any transaction of movable or immovable property is executed
  • Movable property include jewellery, insurance policy, motor cars, motor cycles, horses, any other conveyance, refrigerators, etc but does not include daily usable items like clothes, books utensils, crockery etc

Non-official or outside influence(Rule 20)

  • Shall not bring or attempt to bring any political or other outside influence

Restriction regarding marriage(Rule 21)

  • Shall not enter into or contract a marriage with a person having a spouse living
  • Having a spouse living shall not enter into contract a marriage with a person
  • Exception – Personal law if allows
  • Shall intimate if marry a non-Indian

Consumption-intoxicating drinks/drugs(R- 22)

  • Shall abide any law relating to use of intoxicating drinks, drugs
  • Shall not be under influence of any intoxicating drink or drug during duty
  • Refrain from consuming in a public place
  • Not appear in public place in state of intoxication
